SUPVAN Privacy Policy

Thank you for using software developed and operated by Supvan Technology (Beijing) Co., Ltd. 4th Floor, Building 29, Shangdi East Road, Haidian District, Beijing, China (below abbreviated as “Supvan” or “We/Us”), (below as “Supvan Software”, including but not limited to the free and purchased versions of Supvan software, with versions in English and operating systems and platforms) and the services provided by Supvan. Supvan Privacy Policy (below as “this policy”) describes when you are using Supvan software and services, why and how we collect, use, store, and share your personal information, and the extent of these actions. It further provides channels for your inquiries and corrections and clarifies what would happen if you refuse to provide your personal information.

We pay high attention to your privacy and personal information protection. Before using Supvan’s software and services, please read this policy carefully and make sure you fully understand the content of this privacy policy. Any actions including downloading part of or full software, installing, opening, log in, browsing, using Supvan software or services, will mean that you have agreed Supvan to process your personal information according to this privacy policy.  If you have any questions, suggestions, or advice regarding this privacy policy, please contact us via the channels provided by this policy.

  1. How we collect and use your personal information

Personal Information is defined as the various information that recognizes a particular natural person’s activities, through itself or combined with other information, recorded by electronic or other measures. Personal information does not include publicly available information, which means available from federal, state, or local government records.

Supvan will only collect and use your personal information for the reasons described in this policy.

   a.Use Supvan’s products or services

During your use of Supvan’s products and services, for the normal operation of Supvan products and services, you may need to provide us the information below: your username, the geographic environment and position information(latitude and longitude), device property information (such as hardware model, operating system version, device configuration, Unique Device Identifier UDI, International Mobile Equipment Identity IMEI, Media Access Control address MAC, etc.), device connection information (type of browser, the language used), and device status information. In order to provide integrated service on your different Supvan devices, we may link your personal operating information with the information from your use of Supvan software and services,such as:information in the clipboard, time stamp. We may link your device information with your Supvan service account.

     b.You fully acknowledge that, under circumstances described below, we are not required to obtain your authorization to collect and use your personal information:

  1. Related to public safety, public health, or significant public interest;
  2. Related to a criminal investigation, prosecution, judicial trial, and enforcement of judgment;
  3. For protecting significant legal rights and interests regarding the life or wealth of the subject of the personal information or another person, but difficult to acquire personal approval;
  4. The personal information collected is published to the public by the subject itself;
  5. The personal information is collected through legitimate public information disclosure, such as through legitimate news reports, government information disclosure, etc.;
  6. Needed to sign an agreement according to your requirements;
  7. When needed in academic research and statistics for a public interest, and when the results are being publicly provided or described, the personal information included in the results are being de-identified;
  8. Other circumstances stipulated by laws and regulations.

 

Your personal information may include sensitive private information, such as your ethnic, and religious belief, personal health condition, gender identification information, etc. When you are using our products or services, it is possible that you will upload or publish this sensitive information through public channels, please deal with this information with caution. For the protection of your sensitive information, we recommend you do not upload or publish your sensitive information or your legal name, or personal photo when using our products or services. We are not responsible for how you choose to share your personal information with the public or third parties.

If the information you choose to share includes any third party’s personal information when you are using our products or services, it is your responsibility to make sure that such third party’s prior consent is granted.

Following the updates and upgrades of our products and services, we may adjust the types of collected personal information described in this policy. When the new functions and services are related to the currently provided functions and services, the collected and used personal information will have direct or reasonable relevance to the original purpose of information use. When the information is used in circumstances that have no direct and reasonable relevance to the original purpose of information use, or for other purposes not specified in this policy, or the information collected for certain purpose is being used for other purpose, we will inform or acquire your pre-approval through updating this policy or the privacy notice on the relevant product page. If this information is a sensitive private information, we will acquire your personal approval.

    c.Device Access Permission

  1. Camera Access: To take photo, or scan barcode to acquire information to display on the user interface for client’s use.
  2. Storage Access: to read local files, store files, modify the files, and import information from the document for print.
  3. Position Access: search for the printer’s Bluetooth serial number.
  4. Network Access: to ask for network information acquirement.
  5. Bluetooth Access: to accomplish Bluetooth pairing with the printer, connection, and printing.
  6. Read and write permissions: used to install SUPVAN and run the program stably.

 

2. How we use cookies and similar technology

    a.To ensure the normal operation of the website, we will store a small data file named “cookie” on your mobile device. A cookie usually includes identifiers, site names, and some numbers and characters. With the help of cookie, the website can verify your identification information, ensure safety for data and services, to provide better product and service for you.

We will not use cookie for any purposes other than described by this policy. If your browser or the browser’s additional service allows, you may manage or delete cookies according to your own preference. For details please check https//www.aboutcookies.org/. You may delete all the cookies stored on your computer. Most internet browsers have functions to prevent cookies. But if you do so, you will need to manually change user settings every time when you access our website.

    b.Technology similar to cookie

In the mobile client side of the Supvan software, we use mobile analysis software, to better understand Supvan software’s function in your mobile phone. This software may record information such as the frequency you use the app, the events happening within the app, accumulated use, performance data, and the crash position within the app. Supvan does not link the information chain stored within the analytics software to any of your personal information submitted in Supvan software’s mobile client side.

 

3. Methods and extent that we use the collected personal information

Supvan and other subjects that we deem necessary to receive this information may use your personal information collected by Supvan through or unto ways described below:

 

  1. To provide Supvan software or services to you.
  2. To help Supvan develop and design new products and services, or to improve and upgrade our current products and service.
  3. Make Supvan and other subjects that we deem necessary to receive these information to better understand how you access and use Supvan software and service, so to target and respond to your personalized needs, such as language setting, position setting, personalized help service and directions, or to respond on other aspects related to you or other users.
  4. On the premise that the user's personal information is not being disclosed, allowed (or authorize third-party, including but not limited to domestic or international legal person, organization, agency) to perform technical maintenance or analysis to the whole user database, and to engage in commercial utilization (including but not limited to publish, analysis, or other ways that uses user data information such as amount of visits, time of visits, user preference, etc.).
  5. Supvan has the right to utilize your personal information to perform general and anonymous statistical analysis upon the use of Supvan software and service, the result data can be used by Supvan and other subjects that we deem necessary to receive this information for the purpose bound by this policy. In the meantime, Supvan may share this statistical information with the public, in order to demonstrate the general trends in the use of Supvan software and service. But this statistical information will not contain any identifiable personal information.
  6. Supvan will perform big data analysis with your collected personal information of yours. Supvan may publish and share the big data analysis information with collaborating third-party. The information will not contain any identifiable information.

 4. Share, transfer, and publish the collected personal information

    a.Transfer

 Supvan will share your personal information with selected third parties in and outside the country where you reside, including:

  1. Having acquired your explicit authorization or consent.
  2. To third-party service providers that provide services in support of our products and services.
  3. To meet requirements of laws, regulations, and legal procedures; or compulsive government requirements or judicial judgments.
  4. Should Supvan or Supvan’s affiliated companies are involved into transactions such as merger, separation, liquidation, purchase or sale of asset or business, your personal information may be transferred as a part of this kind of transactions. Supvan will ensure the confidentiality of this information during the transfer and demand the company or organization that then holds the information continue to be bound by this privacy policy. Otherwise, Supvan will request this company or organization to request for your authorization again.
  5. We may disclose your personal information if we are legally required to do so, or if we have a good faith belief that such use is reasonably necessary to:
  • comply with a legal obligation, process, or request;
  • enforce our agreement with you and our policies, and standards, including investigations of any potential violation thereof;
  • detect, prevent, or otherwise address security, fraud or technical issues; or
  • protect the rights, property, or safety of us, our users, a third party or the public as required or permitted by law (including exchanging information with other companies and organizations for the purposes of fraud protection).

    b.Publish

     We will only disclose your personal information to the public under circumstances below:

  1. Having acquired your explicit consent.
  2. Under compulsive demand from law and regulation, legal procedure, litigation, or competent government authority.

You acknowledge and approve, sharing and transferring the de-identified personal information, and make sure that the data receiver cannot recover or re-identify the subject of personal information, will not constitute an action that shares, transfers, or publishes personal information; the storage and process of this information do not require noticing or acquiring your consent.

 

 5. How we protect and store your personal information

   a.Your personal information collected by Supvan through Supvan software and service may be stored and processed at the location of Supvan and its affiliated company, or at other subjects that we deem necessary to receive this information. Supvan will only store your personal information during the undergoing purpose as described by this policy and demanded by law and regulation.

   b.To perform our agreement with you, your personal information will be accessible from and will be processed on Tencent servers, which are located in China.

   c.Under normal circumstances, we only retain your personal information for the shortest time necessary to achieve the purpose of your authorized use. You can also delete your personal information voluntarily, but we will not keep it.

   d. We will adopt any reasonable and enforceable measures to ensure that personal information is unrelated to mobile phones.  We use various safety technology and programs, to prevent the loss, misuse, unauthorized reading, ing, and disclosure of information. Due to the continuous development of technology, our protection measures applied to information safety may be evaded or circumvented by outside causes. Therefore, we provide a reasonable guarantee of information safety within the extent of the law.

  e.Should an unfortunate information safety incident take place, we will inform you in time as demanded by law and regulation: the basic situation of the safety incident and its possible influence, the treatment measure we have or will implement, the advice for your self-prevention action and lowering risk, and our remedy measures to you. We will timely inform you of the related situation through the mail, letter, or phone call. When it is difficult to inform the subjects of personal information one by one, we will publish announcement in a reasonable and effective way.

 

6. Your rights

According to Chinese laws, regulations, standards; and general customs in other countries and regions, we ensure that you can execute these rights to your personal information:

Under circumstances below, you may request us to delete your personal information:

  1. If our action of collection and use of personal information is against law and regulation;

If we decide to respond to your delete request, we will also inform the entities that receive your personal information from us, demand them to delete it in time; unless otherwise stipulated by law and regulation, or these entities have independently acquired your authorization.

7. Protecting information of under-age users

We pay high attention to the protection of underage users’ information. Supvan will not intentionally collect or request personal information from users under 18 years old. If you are under 18 years old, please do not send your personal information to Supvan. In the meantime, before using Supvan software and service, please acquire prior permission from your parents or legal guardian. We suggest that your parents or guardian read this policy carefully, and advise that you use Supvan software and service under the direction of your parents or guardian. Once you download, install, log in or use any part or the entire part of Supvan software or service in any way, it will mean that your parents or legal guardian has agreed that you can use Supvan software or service and agree with the full content of this policy, and permits Supvan collects, uses, stores, and shares your personal information according to this policy. If parents or guardians as a reason to believe that an under-age person has submitted personal information to Supvan without their prior permission, please contact Supvan to ensure this information is deleted.

 

 8. Disclaimer

We do not take any legal responsibility for the occurrence of the events listed below:

  1. A personal information leak is caused by you informing or sharing your personal account with others due to personal reasons. You agree that you will make necessary efforts to protect your account information and keep it confidential. You are exclusively responsible for any and all content you may provide via our product or service, either published in public or sent in private.
  2. Some services in Supvan software are provided by a third party who collaborates with Supvan or its affiliated company. The service provided by a third party is bound by service clauses and personal information protection policy established and published by the third party (and not this policy). You need to read their clauses carefully. This policy only applies to any information collected by SUPVAN and does not apply to any service provided by a third party or its information use rules. Supvan does not take any responsibility for any information used by a third party and provided by you.
  3. Any temporary service suspension caused by a hacker attack, computer virus invasion, or government control.
  4. Any consequences caused by force majeure.
  5. Supvan publishes personal information with prior authorization acquired from you.
  6. According to related laws and regulations, demanded by competent government authority or securities exchange to provide or publish your personal information.
  7. To preserve public interest and thus provide or publish your personal information.
  8. Any leak of your personal information not caused by Supvan.

 

9.  This policy’s extent of application

  1. This policy applies to all versions of Supvan software and all subsidiary services included in Supvan’s service. Notwithstanding this policy does not apply to any information collected by us offline. If a particular version of Supvan software or a particular subsidiary service has a special rule regarding the collection of information, it must both apply to that special rule and this policy; if that special rule has inconsistency with this policy, that special rule applies.
  2. Please pay attention, this policy does not apply to products and services provided by third-party. Supvan software and service may include third-party product or service, and link to third-party’s website. When you use these products or services, your information may be collected. Therefore, it is strongly advised that you read that third-party’s privacy policy, just like reading this policy. Supvan does not take responsibility for how the third party uses their collected personal information of yours, and cannot control how it's being used. This policy does not apply to any other website linked to Supvan software and service.

  10. California privacy notice

  1. We pay high attention to the safety of your personal data and will use appropriate safety measures to prevent unauthorized use or disclosure.
  2. If you are a resident of the State of California, we adopt this notice to observe California Consumer Privacy Act (CCPA), any terms defined in CCPA contain the same meaning as those used in this notice.

 

CCPA gives California consumers “The right to know about the personal information a business collects about them and how it is used and shared;” and the rights to access and control personal information. CCPA has defined “personal information” as “information that identifies, relates to, or could reasonably be linked with you or your household”. Some of the information we collect may not be bound by CCPA, it is thus viewed as public information (as provided by government entities) or protected by federal privacy laws, such as Gramm-Leach-Bliley Act, Health Insurance Portability and Accountability Act, or Fair Credit Reporting Act. When we collect personal information bound by CCPA, this information, our method, and your rights are described as follows:

 a.You have the right to request to access the collected personal information of yours and the sources related to that information, our purpose of collecting it, and information about the third-party and service provider that we share this information to. To protect the personal information of our client, we need to verify your identity first, and then we can take action according to your request.

 b.Under some circumstances, you have the right to request us to delete any personal information we directly collected from you. To protect the personal information of our client, we need to verify your identity first, and then we can take action according to your request. According to laws, we may have reasons to not observe your request, or we may observe it in a way more limited than you expected. If we do so, we will explain in the reply back to you.

c. Residents of California have the right to request us to provide the information of a third party who, for the purpose of direct marketing, that we have disclosed some categories of personal information to them. To make a request, please send your request according to the illustration included in the “how to submit a request” below.

d.We will not discriminate against you for executing any rights granted by CCPA. Unless permitted by CCPA, we will not:

    • Refuse to provide goods or services.
    • Charge different price or rate for goods or services, including giving discounts or other benefits, or impose penalty.
    • Provide different grade or quality for goods or services.
    • Advice that you may receive different price or rate for goods or service, or different grade or quality for goods or service.

But, we may provide you some financial incentive programs permitted by CCPA, these incentives may cause different price, rate, or quality level. Any finance incentive program provided by us will correspond to the reasonable value of your personal information and will include written clauses regarding important aspects of the program. To take part in a financial incentive program needs your prior agreement, you may revoke that agreement at any time.

Supvan considers that the subjects who are necessary to receive this information, as described in policy, include the employees of Supvan and other individual, institute, or organization that Supvan deems necessary. You acknowledge and agree that Supvan collects your personal information through Supvan software and service, and Supvan is allowed to disclose it to subjects who are necessary to receive this information, but Supvan pledges that the subjects who are necessary to receive this information can only use this information for the purpose as bound by this policy. The titles of clauses in this policy are only listed for the convenience of reading. The definite information of the clauses refers to the content articulated within the clauses.

Supvan considers, and you agree, that before you use Supvan software and service, you have carefully read and fully understood the entire content of this policy. Once you use Supvan software and service, it will mean that you agree with the entire content of this policy and promise to be bound by this policy.
